East Lyme Aquatics and Fitness Center (“ELAFC”) Membership Agreement & EFT Agreement

Terms and Conditions: 

  • Benefits: 

    • This membership entitles the purchaser and those included in their membership (“Participants”) to access the fitness and aquatics facilities during operating hours, unless otherwise restricted by management. 
    • Membership also entitles the Participants to use of the locker rooms and amenities. 
      • Please note: all locks must be removed at the close of the business day each day.
          
  • Payment Terms:
     
    • Members of ELAFC consent to mandatory EFT auto-pay for monthly dues.  
    • Membership fees are due at sign up and will automatically be charged each month following. 
    • In the instance your monthly debit is denied or returned by the bank, you will be notified via email and phone.  If no payment is received by the end of that month, your membership will be terminated.  
    • There is a $25 fee for any returned monthly draft charges.  

All fees are non-refundable except under very limited special circumstances, as determined by management.  

  • Cancellation, Pause and Termination: 

    • Members may cancel or pause their membership with a 15-business day written notice by filling out a pause/cancellation form online at https://www.eastlymeschools.org/district/aquatics/membership 
    • Memberships CANNOT be paused or terminated over the phone.  
    • Membership is NOT dependent on usage and will NOT terminate due to non-use.  
    • Members may put their membership on pause for up to 3 months per calendar year.  
    • During pause, Participants may not access the facilities. 
    • ELAFC reserves the right to terminate membership for violation of center policies or misconduct. 
       
  • Health and Safety: 
    • Members are responsible for their own health and safety and should consult with a physician before starting any fitness program. 
    • Members must follow all safety instructions and guidelines provided by staff. 
    • Members must rinse with soap and warm water before entering the pool. 
    • Use of the pool is prohibited if a Participant has diarrhea or any communicable disease. 
    • Children under 14 require an adult present on deck to use the pool.   
    • Children 3 and under must have an adult accompanying them in the water. 

  • Facility Use and Conduct: 

    • Proper attire, including swimwear in the pool area and gym attire in the fitness area, is required at all times. 
    • Participants must wear close-toed shoes in the gym. 
    • Swim diapers MUST be utilized for any child who is not potty-trained. 
    • Members must check in at the front desk upon arrival. 
    • Equipment must be used as intended and returned to its proper place after use.  
    • ELAFC is a smoke-free and alcohol-free facility. 
    • Any damage to property caused by a member will be the member’s financial responsibility. 
    • A Notice of Risk, Waiver, and Informed Consent Agreement must be read and executed.

  • Personal Belongings

    • ELAFC is not responsible for lost or stolen items. 
    • Lockers are available for day use only and must be emptied by the close of business. 
      • Participants acknowledge that any lock left overnight is subject to removal by management.  

  • Changes to Membership Agreement: 

    • ELAFC reserves the right to make changes to this agreement with a 30-day notice to members.  
    • Members will be informed of any changes via email or posted notices within ELAFC

 

East Lyme Aquatics and Fitness Center (“ELAFC”)  
Electronic Funds Transfer (“EFT”) Agreement 

 

ELAFC Membership is an Electronic Funds Transfer (“EFT”) auto-renewal membership that will be automatically charged to the credit card on file associated with the Membership. 

Dues will be automatically billed monthly, starting the date this agreement is signed, and continuing on the same day of the month every month, until which time you notify us that you would like to terminate your membership.   

In the instance your monthly draft is returned for non-payment, you will be notified via email and phone.  If no payment is received by the end of that month, your membership will be terminated and a $25 fee for returned monthly draft charges will be applied to your account.  All fees must be paid before Membership can resume.  

You may cancel or pause your Membership and the continued billing dues by submitting a cancellation form on the East Lyme Public Schools website under “District” then “East Lyme Aquatics and Fitness Center” then “Memberships.”  (https://www.eastlymeschools.org/district/aquatics/membership)  A cancellation notice submitted 15 business days prior to your next billing date will result in no further dues being charged.  

To the extent permitted by law, you authorize ELAFC to initiate separate EFT/CC charges from the account identified and/or any replacement account for the following amounts: (1) your recurring billing dues; (2) a return fee up to $25 for any EFT charge returned unpaid or on a credit/debit care return; (3) any other fee for goods/services provided, as instructed and authorized by you at that time (ie. swim lessons). 

You will receive notice if your EFT membership rate is changing, and will be provided at least 30-days to decide whether to continue your membership before the new rate is charged.  

By signing the Membership agreement, you acknowledge you are of legal age, and agree to ELAFC charging your card on file monthly and all other stipulations herein.

By signing below, I acknowledge that I have read and understood this Membership Agreement, ELAFC’s EFT Agreement, and ELAFC’s Notice of Risk, Waiver, and Informed Consent Agreement (“Agreements”).  I agree to abide by all terms and conditions of all the Agreements listed above, and release ELAFC, its employees, and affiliates from any liability for injuries or damages arising from my use of the facilities.  ELAFC has made no express or implied warranties or representations other than those expressly set forth in these Agreements to induce Participants to enter into said Agreements.  These Agreements constitute the entire agreements between the parties involved, and no other agreements or understandings exist between Participants and ELAFC.   
By entering my name below, I attest that I am the parent/legal guardian of the minor child(ren), that I am signing this Notice voluntarily, that I have read this Notice in its entirety and understand and agree to its terms, and that I consent to my minor child(ren)’s use of the Facilities and participation in the Activities.
